Business Associate Agreement

If you are a covered entity under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and you will be sharing protected health information (“PHI”) with FMLA, you acknowledge and agree that you will not provide PHI to FMLA unless and until you have executed a Business Associate Agreement (“BAA”) with FMLA. You acknowledge and agree that you are in compliance with HIPAA with respect to any PHI you share with FMLA.

These terms of use and our Privacy Policy govern your use of the website generally and any non-PHI information you provide to FMLA. Your sharing of PHI, and FMLA’s use and collection of PHI, is governed by HIPAA and the BAA. Accordingly, you agree to indemnify, defend, and hold harmless FMLA, and its officer, directors, employees, and agents from and against any and all third party claims (including sanctions by the government), damages, losses, fines, penalties, fees, and costs (including reasonable attorneys’ fees) arising out of or related to PHI you share with FMLA prior to executing a BAA with FMLA, your breach of PHI, or your violation of HIPAA.
